What is Against DRM 2.0?

Against DRM 2.0 is a free copyleft license for artworks.

What is copyleft?

Copyleft is a general method for making a program or an artwork free, and requiring all modified and extended versions of the program or of the artwork to be free as well.

Why a new free content license?

Against DRM 2.0 contains two important clauses: a clause about related rights and a clause against DRM (Digital Restrictions Management).
The first clause authorizes licensee to exercise related rights: on the basis of the copyleft clause, performers cannot exercise reserved rights concerning their performances of the work; producers of phonograms cannot exercise reserved rights concerning the phonograms in which they fix the work; broadcasting organizations cannot exercise reserved rights concerning broadcastings of the work.
The second clause prevents the use of DRM to impose restrictions: if licensor uses a DRM system, the license is not applicable to the work; if licensee uses a DRM system, license is automatically void.

If a phonogram-maker produces a CD with songs released under Against DRM 2.0, can I copy and distribute the CD?

Yes, this is an aim of the clause about related rights.

Why do you oppose DRM?

DRM (Digital Restrictions Management) is killing digital freedoms and it represents the principal cause of trusted computing: a business that tramples on users' rights.

Does the license says that I cannot use encryption in any way and in any context?

Against DRM 2.0 says: This license concerns copyright and related rights: this license does not treat any other right.
Nothing in this license is intended to prevent or restrict the exercise of rights not treated in this license, such as rights concerning privacy, private property, sale and other personal or private rights.
Nothing in this license is intended to prevent or restrict the private use of any lawful technological measure.

So you can use encryption to defend your privacy, your private property (for example, you can limit the access to your server, you can use a firewall... ), your rights of sale (for example, you can prevent the access to the content of a CD for sale, but you cannot sell a CD with an access control system or a copy control system)... and you can use privately any lawful technological measure (you can protect your personal copy with any system); but you cannot distribute the work with an access control system or a copy control system.

Is Against DRM 2.0 compatible only with itself?

No, Against DRM 2.0 is compatible with any other license that provides:
a. the renunciation to exclusive exercise of granted rights;
b. an anti-DRM clause;
c. a copyleft clause.

Is Against DRM 2.0 applicable to software?

No, softwares and databases are out of license's area of applicability.

Any breach of this license (in particular, the breach of the articles 6 and 7) will automatically retroactively void this license: why this specification (in particular, the breach of the articles 6 and 7)?

There is an important motive behind this specification:
in many countries a license is a contract and in some countries a general resolutory clause must be signed by parts, otherwise the clause is void: nullity of resolutory clause (serious problem).

Which rights can licensor reserve to himself?

Moral rights: independently of the author's economic rights, and even after the transfer of the said rights, the author shall have the right to claim authorship of the work and to object to any distortion, mutilation or other modification of, or other derogatory action in relation to, the said work, which would be prejudicial to his honor or reputation.
Moral rights aren't totally recognized in all countries: the big exception are United States, in which moral rights (rights of attribution and integrity) are legally recognized only for works of visual art.

Can I modify licensed work?

Yes, but remember that you cannot trespass possible moral rights.

What about the copyright notice?

If you distribute, broadcast, publicly display or publicly perform the work or any derivative work, you must keep intact the copyright notice.
